  1. Parties, Scope, and Acceptance

This Website Privacy Policy (the Policy) is provided by Workers Rights Law Firm, APC (the Firm, we, us, or our) and applies to personal information we collect from or about individuals who visit or interact with our website (the Website) (each, a Consumer or you). By accessing or using the Website, you acknowledge that you have read and understood this Policy. This Policy is intended to provide disclosures and rights information required under applicable California privacy laws, including the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act and implementing regulations (collectively, California Privacy Law).

  1. Definitions

For purposes of this Policy:

  1. Personal Information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Consumer or household, consistent with California Privacy Law.
  2. Sensitive Personal Information includes the categories of sensitive personal information recognized under California Privacy Law, including, where applicable, government identifiers; account log-in credentials; precise geolocation; racial or ethnic origin; religious or philosophical beliefs; union membership; contents of mail, email, or text messages where the Firm is not the intended recipient; genetic data; biometric information; health information; and information concerning sex life or sexual orientation.
  3. Sell, Share, and Service Provider have the meanings set forth in California Privacy Law.
  4. California Jurisdiction; California Privacy Rights

This Policy is governed by and shall be construed under the laws of the State of California, without regard to conflict-of-laws principles, to the extent applicable. Where California Privacy Law grants California residents specific rights regarding their Personal Information, the Firm will provide those rights as described in this Policy.

3. Categories of Personal Information We Collect

Depending on how you use the Website, we may collect the following categories of Personal Information (as applicable and as defined by California Privacy Law):

  1. Identifiers, such as name, alias, postal address, unique personal identifier, online identifier, internet protocol address, email address, account name, and similar identifiers.
  2. Internet or other electronic network activity information, such as browsing history, search history, and information regarding your interaction with the Website.
  3. Geolocation data, to the extent collected through your device or browser settings.
  4. Professional or employment-related information, to the extent you choose to provide it through Website forms or communications.
  5. Inferences drawn from the information described above to create a profile reflecting preferences or characteristics, to the extent such inferences are generated through Website interactions.
  6. Phone numbers including mobile phone numbers if they are provided.

We may also collect Sensitive Personal Information only to the extent you choose to provide it to us through your communications or as otherwise permitted by California Privacy Law.

4. Purposes for Collection and Use

We collect and use Personal Information for business and operational purposes consistent with California Privacy Law, including to:

  1. Operate, maintain, and secure the Website and related systems;
  2. Communicate with you, respond to inquiries, and provide information you request;
  3. Improve the Website’s functionality, performance, and user experience;
  4. Detect, prevent, and respond to security incidents and other malicious, deceptive, fraudulent, or illegal activity; and
  5. Comply with applicable legal obligations and enforce this Policy and other terms applicable to the Website.
  6. No Sale or Sharing of Personal Information (California)

The Firm does not sell Personal Information and does not share Personal Information for cross-context behavioral advertising. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties

5. Disclosures of Personal Information; Service Providers

We may disclose Personal Information to service providers that help us operate the Website and provide services, provided that such disclosures are limited to what is reasonably necessary and are subject to appropriate contractual restrictions consistent with California Privacy Law. We do not disclose Personal Information to third parties for their own direct marketing purposes in a manner that would constitute a sale or sharing under California Privacy Law.

6. SMS Communications and Right to Limit Use and Disclosure of Sensitive Personal Information (If Applicable)

To the extent the Firm collects Sensitive Personal Information, the Firm will use and disclose such Sensitive Personal Information only as permitted by California Privacy Law, including for purposes necessary to provide the Website and related services, to ensure security and integrity, and for other permitted business purposes. Where required, you may have the right to limit the use and disclosure of Sensitive Personal Information.

By providing your mobile telephone number to the firm (including through the Website, an intake form, or other communications) and/or by otherwise requesting that the Firm communicate with you by text message, you expressly authorize and consent to receive SMS/text messages from the Firm at that number for purposes reasonably related to your inquiry and the Firm’s services, including appointment scheduling, intake and case-related communications, status updates, and administrative messages. You acknowledge and agree that message and data rates may apply depending on your mobile service plan and carrier, and that message frequency may vary. You further acknowledge that your consent to receive SMS/text messages is not a condition of purchasing any goods or services from the Firm, and you may revoke consent and opt out at any time by (i) replying “STOP” to any text message from the Firm, or (ii) sending an email request to admin@workersrightslawfirm.com identifying the mobile number to be opted out; the Firm will use commercially reasonable efforts to honor opt-out requests within a reasonable time after receipt.

7. California Privacy Rights

California Civil Code section 1798.83 permits California residents, beginning January 2005, to request certain information regarding a business’s disclosure of personal information to third parties for the third parties’ direct marketing purposes. To the extent applicable, you may submit such a request to the Firm by writing to the contact method specified in Section 10. If applicable, within 30 days of receiving a proper request, the Firm will provide the categories of personal information disclosed to third parties for their direct marketing purposes, if any, and the names and addresses of such third parties for the immediately preceding calendar year. The Firm may limit responses to one request per Consumer per calendar year and may require that requests be submitted using the contact method specified in Section 10.

To exercise applicable California privacy rights or to submit questions about this Policy, you may contact the Firm using the contact information made available on the Website at admin@workersrightslawfirm.com. Your request should include sufficient information for the Firm to reasonably verify you and to understand and respond to your request consistent with California Privacy Law.

9. Updates to This Policy

The Firm may update this Policy from time to time. The updated Policy will be posted on the Website and will be effective as of the date of posting, unless otherwise stated.
